Welcome! Please read these Policy Minds Terms of Service (the “Agreement”) carefully.

This Agreement is a legally binding agreement between you and GODITSME.ORG (“Policy Minds” or “we” or “us”). By clicking or tapping any button, box, or other icon marked “I Accept,” “I Agree,” or “OK” (or any similar term) in connection with this Agreement, or by otherwise accessing and using the public services (as defined below), you acknowledge and agree to this Agreement, and you further confirm that you are of legal age where you live and that you have the legal capacity to enter into this Agreement.

This Agreement governs your access to, and use of all public services provided by Policy Minds in connection with Policy Minds’s online platform, made available at the website and associated domains of policyminds.org or via other websites or means as we may determine from time to time (the “public services”). This Agreement hereby incorporates by this reference any additional terms and conditions posted by Policy Minds in connection with the public services, or otherwise made available to you by Policy Minds.

IF YOU ARE AN INDIVIDUAL ACCESSING OR USING THE PUBLIC SERVICES ON BEHALF OF, OR FOR THE BENEFIT OF, ANY CORPORATION, PARTNERSHIP OR OTHER ENTITY WITH WHICH YOU ARE ASSOCIATED (AN “ORGANIZATION”), THEN YOU ARE AGREEING TO THIS AGREEMENT ON BEHALF OF YOURSELF AND SUCH ORGANIZATION, AND YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL AUTHORITY TO BIND SUCH ORGANIZATION TO THIS AGREEMENT. In such a case, references to “you” and “your” in this Agreement will refer to both the individual using the public services and to any such Organization. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION THAT, AS FURTHER SET FORTH IN SECTION 23 BELOW, REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR ANY OTHER COURT PROCEEDINGS, OR CLASS ACTIONS OF ANY KIND.

1. Non-Refundable Donations and Memberships

Policy Minds is a 501(c)(3) nonprofit organization operating through donations and membership fees. All donations and membership contributions are non-refundable. These funds are critical to the immediate operations and mission-driven activities of Policy Minds, including maintaining and enhancing our AI-driven platform.

Donors and members will receive a tax-deductible receipt for their contributions, ensuring compliance with IRS regulations. If you require assistance with your receipt, please contact us at info@policyminds.org.

2. Jurisdictional Issues

The public services are controlled or operated from the United States and are not intended to subject Policy Minds to any non-U.S. jurisdiction or law. Access to and use of the public services is intended solely for users within the United States. If you choose to access the public services from outside the U.S., you do so at your own risk and are responsible for ensuring compliance with local laws. Any access to or use of the public services and any output must comply with all applicable federal, state, local, or foreign laws (including common law), codes, statutes, ordinances, rules, regulations, regulatory bulletins, interpretations or guidance or orders, decrees and orders of, official releases or any other requirements by, any governmental authority or agency (“Applicable Laws”). We may limit the availability of the public services at any time, in whole or in part, to any person, geographic area or jurisdiction that we choose.

3. Use Restrictions

You may use the public services only for lawful purposes and in accordance with this Agreement and Policy Minds’s Acceptable Use Policy, the current version and any updated versions of which are available at “https://policyminds.org/acceptable-use-policy” and is hereby incorporated by reference. Examples of prohibited activities include, but are not limited to:

  • Attempting to reverse-engineer or tamper with the AI-generated outputs.
  • Using the platform for disinformation or automated data scraping.
  • Misusing the AI to introduce biases into digital representations of political figures.
  • Engaging in any activity that violates applicable laws.

We reserve the right to revise the Acceptable Use Policy and notify you of updates via the website or other reasonable means. You acknowledge that we may (a) revise the Acceptable Use Policy in our sole discretion, from time to time, and (b) notify you of any such revision by any reasonable means, including by posting such revised Acceptable Use Policy through or in connection with the public services or our website. You acknowledge and agree that the public services may be subject to limits on the amount of your use (e.g., rate limits) that correspond to the tier of public service obtained by you.

Privacy Policy

Policy Minds’s Privacy Policy, located at https://policyminds.org/privacy-policy, sets forth how we may collect, use, store, and process your personal information. By using the public services, you acknowledge that you have read and understand our Privacy Policy and agree to its terms.

5. Products & Transactions

Products and Listings: The public services may display listings, descriptions, and images of products or public services, including references and links to third-party products. The availability of any listing does not imply endorsement by Policy Minds.

Transactions: We may offer the ability to purchase or obtain certain products through a third party in connection with the public services. You are responsible for ensuring compliance with applicable laws when making transactions. All payments are processed through third-party payment public services, and we have no control over their privacy practices. YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT TO USE ANY CREDIT CARD THAT YOU SUBMIT IN CONNECTION WITH A TRANSACTION. By submitting such information, you grant us the right to provide such information to third parties for purposes of facilitating transactions. Verification of information may be required prior to the acknowledgment or completion of any transaction. By making a transaction, you represent that the applicable products will be used only in a lawful manner.

6. Disclaimer of Warranties

EXCEPT AS REQUIRED BY LAW, THE PUBLIC SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. POLICY MINDS DOES NOT GUARANTEE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED CONTENT. YOU ACKNOWLEDGE THAT THE PUBLIC SERVICES (INCLUDING BETA PUBLIC SERVICES) OR THE OUTPUT MAY INCLUDE BUGS, INACCURACIES, ERRORS AND MATERIALS THAT VIOLATE OR CONFLICT WITH THIS AGREEMENT. Additionally, third parties may make unauthorized alterations to the public services. If you become aware of any such alteration, contact us at info@policyminds.org with a description of such alteration and its location on the public services.

7. Limitation of Liability

Donations and memberships to Policy Minds are contributions made to support our nonprofit mission and are not payments for specific public services. As such, these contributions are non-refundable. If you are dissatisfied with the public services provided, your sole remedy is to discontinue use of the platform.

The maximum liability of Policy Minds, in any case where it is found liable, is limited solely to the amount you have paid for any optional fee-based public services specifically offered through the platform, excluding any donations or membership contributions.

EXCEPT TO THE EXTENT EXPRESSLY PROHIBITED BY APPLICABLE LAW:

  • POLICY MINDS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, UNDER ANY CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, INCLUDING DAMAGES FOR LOSS OF PROFITS, USE OR DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INPUTS (INCLUDING UNAUTHORIZED INTERCEPTION BY THIRD PARTIES OF ANY INPUTS), EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES;
  • WITHOUT LIMITING THE FOREGOING, POLICY MINDS WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PUBLIC SERVICES OR FROM ANY PRODUCTS OR THIRD PARTY MATERIALS, INCLUDING FROM ANY VIRUS (AS DEFINED IN THE ACCEPTABLE USE POLICY) THAT MAY BE TRANSMITTED IN CONNECTION THEREWITH;
  • YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE PUBLIC SERVICES OR ANY PRODUCTS OR THIRD PARTY MATERIALS IS TO STOP USING THE PUBLIC SERVICES;
  • THE MAXIMUM AGGREGATE LIABILITY OF POLICY MINDS FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL BE THE GREATER OF (I) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO POLICY MINDS TO USE THE PUBLIC SERVICES, AND (II) $100.00.

ALL LIMITATIONS OF LIABILITY OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THIS AGREEMENT) ARE MADE FOR THE BENEFIT OF BOTH POLICY MINDS AND THE AFFILIATED ENTITIES, AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS.

8. Indemnity

To the fullest extent permitted under Applicable Law, you agree to defend, indemnify and hold harmless Policy Minds and the Affiliated Entities, and their respective successors and assigns, from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses and fees (including attorneys’ fees) arising out of or relating to:

  • (a) your use of, or activities in connection with, the public services (including all Inputs and Outputs);
  • (b) any violation or alleged violation of this Agreement by you; and
  • (c) any violation or alleged violation of Applicable Law by you.

Subscriptions, Donations, and Auto-Renewals

If you subscribe to any optional fee-based services, your subscription will automatically renew unless otherwise specified. Policy Minds may adjust subscription fees with 14 days' notice via email or through the website. Users are responsible for ensuring their payment information remains current.

Please note that donations, pledges, and memberships are treated as contributions to support our mission rather than payments for public services, and they do not automatically renew unless explicitly stated at the time of contribution. These contributions are non-refundable and are vital to the continued operation and growth of our platform.

Registration; Usernames and Passwords

You may need to register to use all or part of the Policy Minds platform. We may reject, or require that you change, any username, password or other information that you provide to us in registering. Your username and password are for your personal use only and should be kept confidential. You, and not Policy Minds, are responsible for any use or misuse of your username or password, and you must promptly notify us of any confidentiality breach or unauthorized use of your username or password, or your public services account. IF YOU CHOOSE TO MAKE ANY OF YOUR PERSONALLY IDENTIFIABLE OR OTHER INFORMATION AVAILABLE THROUGH OR IN CONNECTION WITH THE PUBLIC SERVICES, YOU DO SO AT YOUR OWN RISK. You are responsible for obtaining, maintaining and paying for all hardware and all telecommunications and other public services needed to use the public services.

Arbitration & Dispute Resolution

All disputes arising out of this Agreement shall be resolved through binding arbitration under the American Arbitration Association’s Commercial Arbitration Rules, unless you opt-out within 30 days of agreeing to this Agreement. Arbitration will take place in King County, Washington.

Confidentiality & User Content

User-Generated Content and Input

As a user of the Policy Minds platform, you may provide certain inputs, materials, or content through or in connection with the public services (collectively, “Input”). This may include transcripts, video clips, statements, and other materials that are used to create and train the AI alter ego of a political figure. You may receive information, reports, and other results based on your Input (collectively, the “Output”). Together, Input and Output are referred to as “Content,” excluding Third-Party Materials.

Ownership and Licensing of Content

You retain ownership rights in the Input you provide. However, to enable us to operate the Policy Minds platform and improve the AGC (Artificially Generated Consciousness) systems, you grant Policy Minds a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable, and sublicensable license to use, analyze, reproduce, adapt, distribute, and display your Content. This license is essential for the AI models to learn and develop as intended, ensuring that each Policy Mind™ reflects the character and essence of the political figure it represents.

Policy Minds' Role in Content

Policy Minds does not claim ownership of your original Input, nor do we control the content provided by users. Our role is primarily to monitor and verify that the Content provided aligns with our acceptable use policy and community guidelines. We are not responsible for managing or curating the specific materials used to train each Policy Mind™. The accuracy and quality of the Policy Mind depend largely on the diligence and attention of the user or representative responsible for uploading accurate materials.

Accuracy and Risk

Policy Minds makes reasonable efforts to verify that user-uploaded content is authentic and verifiably attributed to the political figures represented. However, Policy Minds does not independently verify the accuracy of every statement or Input provided. You accept and agree that any use of the Outputs from the public services is at your sole risk. It is your responsibility to evaluate the accuracy and appropriateness of Outputs for your intended use.

No Guarantee of Unique Outputs

Due to the nature of the public services, Output from the AGC models may not be unique, and other users may receive similar Outputs from their interactions with the public services. Policy Minds makes no guarantees about the uniqueness or originality of AI-generated responses.

Responsibility for Inputs

As the user or creator of a Policy Mind™, you represent and warrant that you have all necessary rights and authority to provide the Input used to train the AGC. You agree that your Input is accurate, lawful, and free of any third-party claims, and that it does not infringe any intellectual property rights or violate any privacy laws.

User Liability

Given that you have control over the educational content uploaded to each Policy Mind™, Policy Minds is not liable for any inaccuracies, errors, or misrepresentations that result from the uploaded data. You agree to indemnify and hold Policy Minds harmless from any claims or disputes arising from your uploaded content.

Feedback and Improvements

If you provide us with any ideas, suggestions, or feedback regarding the public services, you grant Policy Minds a non-exclusive, royalty-free license to use, adapt, and implement such feedback to improve our public services and AGC models.

Monitoring

Scope of Monitoring

Policy Minds reserves the right to monitor the Inputs provided by users for the purpose of ensuring compliance with our acceptable use policies. While we may review certain materials, Policy Minds does not assume an obligation to actively monitor all user submissions.

Content Removal

Policy Minds may remove or restrict access to content that violates our terms of public service or applicable laws, but we do not assume responsibility for moderating the specific narratives or perspectives of any given Policy Mind™.

Changes to Terms & Termination

Policy Minds reserves the right to modify or discontinue the public services at any time. Any changes to these terms will be communicated to users in advance. If you continue to use the public services after such changes, you agree to the modified terms. We may change, modify, or supplement this Agreement from time to time at our sole discretion by notifying you of such changes by any reasonable means, including by posting a revised Agreement through or in connection with the public services. No such changes will apply to any dispute between you and us arising before the date on which we posted the revised Agreement incorporating such changes, or otherwise notified you of such changes. However, any changes to the dispute resolution provisions set out herein will not apply to any disputes for which the parties have actual notice before the date the change will be effective. Your use of the public services following any changes to this Agreement will constitute your acceptance of such changes. The “Last Updated” legend above indicates when this Agreement was last changed. We may, at any time and without liability, modify or discontinue all or part of the public services (including access to the public services via any third-party links); charge, modify or waive any fees required to use the public services; or offer opportunities to some or all public services users.

Policy Minds IP Rights

As between you and Policy Minds, all rights, title, and interest in and to the public services and all associated intellectual property rights are retained by Policy Minds. This includes, but is not limited to, data models, model weights, embeddings, algorithms, and other proprietary technology used in the development, training, and deployment of Artificially Generated Consciousness (AGC) profiles. The AGC models and the methodologies behind their creation, including unique configurations for different political figures, are protected as proprietary intellectual property.

Our trade names, trademarks, and public service marks, including Policy Minds and any related logos, are legally protected assets. These marks signify the quality and origin of the public services we offer. You may not use our trade names, trademarks, public service marks, or logos in connection with any product or public service that is not affiliated with Policy Minds, or in any manner that is likely to cause confusion among users. Nothing in these Terms of Service grants you the right to use any of our intellectual property, including trademarks, without obtaining express prior written consent from us. Unauthorized use of these marks may result in legal action.

Confidentiality

In using the public services, you may gain access to confidential information about Policy Minds, including details of past, present, and future activities, research and development efforts, business strategies, and proprietary technologies related to our AI models and AGC systems. This information may be specifically identified as Confidential Information or should reasonably be understood to be confidential due to its nature or context.

Confidential Information may only be used by you in a manner that is consistent with the rights and obligations outlined in this Agreement and solely for the purposes of engaging with the Policy Minds platform. Except where permitted by law or required for legal compliance, you agree not to disclose any Confidential Information to third parties without prior written consent from Policy Minds.

You agree to safeguard this Confidential Information with at least the same degree of care that you would use to protect your own sensitive information, but in no event using less than a reasonable standard of care. If you are acting on behalf of an Organization, you may disclose Confidential Information to your authorized personnel or subcontractors only if they have a legitimate need to know the information to fulfill their duties under this Agreement. Such personnel must also be bound by confidentiality obligations that are no less restrictive than those in this Agreement.

This confidentiality obligation does not apply to information that:

  • Was already known to you without an obligation of confidentiality before receiving it from Policy Minds;
  • Was independently developed by you without using or referencing Confidential Information provided by Policy Minds;
  • Was acquired from a third party who is not bound by a confidentiality obligation to Policy Minds; or
  • Has become publicly available through no breach of this Agreement.

By respecting these terms, both parties ensure that sensitive information remains secure while enabling Policy Minds to continue its mission of providing a platform for transparent political engagement.

Copyright Infringement Claims

The Digital Millennium Copyright Act of 1998 (DMCA) provides recourse for copyright owners who believe that material available on the internet infringes their rights under U.S. copyright law. If you believe in good faith that material on the Policy Minds platform infringes your copyright, you (or your agent) may send a written notice to Policy Minds requesting that we remove the infringing material or block access to it.

If you believe in good faith that someone has wrongly filed a notice of copyright infringement against you, the DMCA permits you to send Policy Minds a counter-notice. All DMCA notices and counter-notices must meet the statutory requirements imposed by the DMCA, including providing sufficient details of the alleged infringement or misrepresentation. For further information on these requirements, you may refer to the U.S. Copyright Office at http://www.copyright.gov/.

Export Controls

Policy Minds is subject to United States export controls. Users accessing the public services are responsible for complying with these controls, including any embargoes or federal regulations restricting exports. By using the public services, you represent and warrant that:

  • You are not located in, or a resident or national of, any country subject to a U.S. government embargo or other restrictions, nor are you on any U.S. government list of restricted or prohibited parties.
  • You will not use the public services for any purpose prohibited under U.S. export laws, including but not limited to nuclear, chemical, or biological weapon proliferation activities.
  • Policy Minds reserves the right to restrict access to users in countries where the public services are not permitted by U.S. law or where the use of such public services would result in a violation of these controls.

Miscellaneous

This Agreement does not, and shall not be construed to, create any partnership, joint venture, employer-employee relationship, or franchisor-franchisee relationship between you and Policy Minds. If any provision of this Agreement is found to be unlawful, void, or unenforceable, such provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provisions.

You may not assign, transfer, or sublicense any of your rights or obligations under this Agreement without our express prior written consent. We may assign, transfer, or sublicense any or all of our rights or obligations without restriction.

Waivers of any breach or default by either party will not be considered a waiver of any other breach or default. Any headings, captions, or section titles contained herein are for convenience only and do not define or explain any section or provision.

If the software associated with the public services is construed as “commercial computer software,” as defined in 48 CFR 2.101, all U.S. government end users may only acquire access to such software in accordance with the rights outlined in 48 CFR 12.212(b) and 48 CFR 227.7202-1(a) and 48 CFR 227.7202-4.

Notices to you, including changes to this Agreement, may be provided through postings on our website or by email. A printed version of this Agreement, and any notice provided in electronic form, shall be admissible in judicial or administrative proceedings to the same extent as other business documents originally generated and maintained in printed form. Policy Minds will not be liable for any failure to fulfill its obligations due to circumstances beyond its control, including but not limited to natural disasters, communication failures, or acts of government.
